Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your") and WYSE-B / EJ Support IT ("we", "us", "our") governing your access to and use of EbSpace, a property management platform consisting of web and mobile applications (the "Service").

By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Account & Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your credentials and for any activity occurring under your account.

You agree to provide accurate, current, and complete information during registration and to keep it up to date.

3. Subscription & Billing

EbSpace is offered on a recurring subscription basis. Current pricing is published on our product page. By subscribing, you authorize us (and our payment processor, Stripe) to charge your selected payment method on a recurring basis until you cancel.

  • Renewal: Your subscription renews automatically at the end of each billing period at the then-current price.
  • Cancellation: You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period; no refunds are issued for the unused portion of a billing period unless required by law.
  • Price changes:We may change pricing with at least 30 days' notice. Price changes take effect at your next renewal.
  • Taxes & fees: Prices do not include taxes and applicable third-party processing fees, which may be added at checkout or passed through.

4. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Upload or share content that infringes intellectual property, privacy, or other rights
  • Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
  • Interfere with or disrupt the Service or the servers and networks that host it
  • Use the Service to send spam, malware, or other harmful content
  • Resell, sublicense, or commercially exploit the Service without our prior written consent

5. Your Content

You retain ownership of the content you submit (property listings, tenant data, documents, messages, etc.). You grant us a limited, worldwide, non-exclusive license to host, store, process, and display your content solely to operate and provide the Service.

You represent that you have all rights necessary to grant this license and that your content does not violate any law or third- party rights.

6. Tenant & Payment Processing

When you use EbSpace to collect rent or other payments from tenants, payments are processed through Stripe Connect. Our Service merely facilitates payment processing — we are not a party to the financial transaction between you and your tenants.

  • Stripe terms:Use of payment processing is subject to Stripe's terms and acceptable use policies.
  • Refunds & disputes: Resolution of disputes and refunds between you and your tenants is your responsibility.
  • Compliance: You are responsible for compliance with applicable landlord-tenant, consumer protection, tax, and financial regulations in your jurisdiction.

7. Intellectual Property

The Service, including all software, design, text, graphics, and branding (excluding your content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the Service will be free from errors, interruptions, or security incidents.

9. Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with these Terms or the Service. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or for any other lawful reason. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (intellectual property, disclaimers, limitations of liability, indemnification, and miscellaneous) will survive termination.

12. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of- laws provisions. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you by email or in-app notice. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
